AOL must have missed the uproar over the DOJ's demand for "anonymized" search data last year that caused all sorts of pain for Microsoft and Google. That's the only way to explain their release of data that includes 20 million web queries from 650,000 AOL users.
The data includes all searches from those users for a three month period this year, as well as whether they clicked on a result, what that result was and where it appeared on the result page. It's a 439 MB compressed download, expanded to just over 2 gigs. Enkele conclusies:
1. De richtlijn over gegevensbescherming (95/46/EG) is algemeen van toepassing op de verwerking van persoonsgegevens door zoekmachines, ook wanneer deze hun hoofdkantoor buiten de EER hebben.
4. Zoekmachines mogen persoonsgegevens uitsluitend verwerken voor gerechtvaardigde doeleinden en de hoeveelheid gegevens moet ter zake dienend en niet bovenmatig zijn, uitgaande van de diverse doeleinden.
5. Exploitanten van zoekmachines moeten persoonsgegevens die niet langer nodig zijn voor het doel waarvoor zij werden verzameld, wissen of anonimiseren (op onomkeerbare en doeltreffende wijze).
6. De bewaringstermijnen moeten zo veel mogelijk worden beperkt en in verhouding staan tot elk van de door de exploitanten van zoekmachines geformuleerd doeleinde. Gelet op de eerste verklaringen van de exploitanten van zoekmachines over de mogelijke doeleinden van het verzamelen van persoonsgegevens, ziet de werkgroep geen reden voor een bewaringsperiode van meer dan zes maanden. In nationale wetgeving kan echter worden bepaald dat persoonsgegevens eerder moeten worden gewist. Indien exploitanten van zoekmachines persoonsgegevens langer dan zes maanden bewaren, moeten zij uitvoerig aantonen dat dit strikt noodzakelijk is voor de dienstverlening. Informatie over de door de exploitanten van een zoekmachine vastgestelde bewaringstermijn moet in elk geval eenvoudig op hun homepage zijn in te zien.
7. Hoewel het als gevolg van standaard HTTP-verkeer onvermijdelijk is dat exploitanten van zoekmachines enige persoonsgegevens verzamelen over de gebruikers van hun diensten, hoeven zij geen aanvullende persoonsgegevens over individuele gebruikers te verzamelen om zoekresultaten en advertenties te kunnen aanbieden.
10. Voor het uitbreiden van gebruikersprofielen met gegevens die de gebruikers niet zelf verstrekken, is de toestemming van de betrokkenen vereist.
16. Gegevens die afkomstig zijn van verschillende diensten van dezelfde zoekmachine mogen alleen aan kruiscorrelatie worden onderworpen als de gebruiker voor die specifieke dienst toestemming heeft gegeven.

Welke gegevens staan bij ons geregistreerd?
In onze database worden gegevens opgenomen van mensen die betrokken zijn bij een faillissement, met een deurwaarder in aanraking zijn gekomen of op een andere manier betalingsproblemen hebben. Met die informatie kunnen bedrijven die artikelen of diensten op krediet leveren, zichzelf beschermen tegen financiële risico's. Maar de consument heeft zelf ook belang bij een registratie.
